2018 Round-Up: Key Connecticut Court Decisions Impacting Health Care Providers

In 2018, the Connecticut Supreme Court issued three noteworthy decisions that: created a private cause of action for breach of the duty of confidentiality arising from the physician-patient relationship; found a hospital vicariously liable for the negligence of a medical resident; and provided further gloss on when non-patients are precluded from bringing a malpractice action against a health care provider. The federal District Court in Connecticut tackled the question of whether a Medicare Advantage Organization is entitled to bring a private cause of action to recover double damages from a tortfeasor for the medical expenses it paid in connection with a personal injury claim.
